Conditions of Use

REGULATION

§ 1.

The internet shop (called "shop" hereinafter) is available on the internet address www.ortho-shoes.com   and is led by Daritom  Bartosz Włodarczyk company, registered in Record Economic Activity Municipal Council in Gdańsk (POLAND) under number   126263; REGON: 631265566 NIP: PL 781-138-85-56, seated in 80-809 Gdańsk, Cieszyńskiego street 20/31 (POLAND). 
The internet shop sells, by the agency of Internet, prophylactic - corrective (orthopedic) footwear, called "goods" hereinafter. A client makes his payment only in the form of a bank transfer. 
A client making his/her order in the internet shop gives his/her assent to personal data transformation made by Daritom Bartosz Włodarczyk who is a data administrator and use them for purposes connected with sale realization ordered by a Client and for Daritom Bartosz Włodarczyk marketing purposes. A client has a right to inspect, complete and modify related to him data that are administrated by Daritom (legal basis: Act from  29th July 1997 about personal data protection Act no. 101, item.926 from 2002 with later amendments -law Poland).

§ 2.

Orders are taken by www.ortho-shoes.com
The order is accepted at the moment of transferring money into the Shop's account in the amount that is defined in the price list. 
The dispatch of ordered products takes place, according to Act 4$2, immediately after fulfilling all conditions referring to Act 2. 
Presented footwear models are produced for individual client's order and approximate awaiting time for making shoes takes about 21 days + time to delivery. 
Footwear, presented under AURELKA trade mark, may be modified by a client and such modification can encompass: changing color (for other than presented colors), cutting to size  Velcro   belt, making a shoe according to orthopedist's guideline etc. Such changes should be submitted before making an order. Any changes cause raising of a product's price for about 20%. 
Sending a special order is tantamount to canceling shop's prices as well as the price of purchase sent to client in a confirmative e-mail. 
Price for a special order shall be sent in a special e-mail entitled "SPECIAL ORDER". 

 § 3.

The order is executed on condition that a given product is available in the shop's storehouse or shop's suppliers. In case of lacking some of products which are part of an order, a client is informed about a state of his order and can choose the way of purchase realization (only partial realization, extend time of purchase realization, canceling the whole order).  

§ 4.

For each order VAT invoice is made out. 
VAT invoice is made out when all products ordered by a client are compiled and ready to send. 

§ 5.

A client can not cancel his order after sending ordered products by the shop. 

§ 6.

 All prices are in Euro. Price given next to a product is binding in the time of making an order. The shop reserve the right to change prices of products that are available in an offer, add new products to a shop's offer, conduct and cancel promotional actions on shop's website or change them. 
The shop is not responsible for insignificant differences of footwear colors presented in photos. Footwear colors are not always the full reflection of reality. Differences between hues may be caused by changes of leather supplier (tannery), by producer, natural differences in material texture or by change of a dye agent.  THE SHOP IS NOT RESPONSIBLE FOR SUCH CHANGES. Complained referring to such changes will not be considered.  We inform You that differences between colors may result from using different type of leather, e.g. nubuk or grain, where nubuk gives different hue of the same color than grain.  
Delivery costs are calculated automatically on the order form. Delivery costs are borne by a client.
Shipments are delivered by a courier company. Delivery costs are 20,00 euro. Irrespective of the number of ordered pair of shoes, sum of money is 20,00 euro gross (on condition that the delivery address remains the same).  
A package is send directly from a producer or our shop
An invoice for ordered goods is send in e-mail or by Polish Post Office (on client's request only). 

 § 7.

 A client has a right to withdraw from agreement only by making an appropriate document in a written form not later than 10 days after delivering a product. Return of a product which is a result of withdrawing from agreement takes place by client's effort and at client's expense. 
A product should be sent back to the shop along with an invoice as well as with a "statement" referring to exercise the right of withdraw (Act 1). 
A product must be sent back in the original and complete packaging and cannot have any traces of exploitations (any sole dent made by sand, sole scratch, wear out of a sole, soil of sole, soil of lining, soil of leather, etc.). 
The shop guarantee return of whole amount of money in case of fulfilling all conditions from Act 2 and 3$7. Return of costs pay by bank transfer on a client's account shall be in 10 working days.  Cost of sending back product is not returning back

§ 8.

All products available in the shop are under producer's guarantee. 
If after receiving a product, a client find some technical defects or damages made during delivery, he should immediately contact the Shop. The Shop shall give proposition of examining and considering a complaint.  
A defect means change of product's character as a result of improper   or bad quality material used for producing footwear or improper technology or constructive solutions.
Any change which is considered to be a normal wear of footwear such as wear out of a sole, soil of sole, soil of lining, deformation made during adapting shoe to a given foot or decolorization, being a result of wet or sweat, improper use and improper care, natural material changes or any other damages made by user or any other person, are not considered to be a defect.  
In case of noticing any defect, a Client should act in accordance with a guarantee (if such a guarantee is added to a product). 
The Shop does not accept any packages send by a client to the shop by postal-order collection. 
Before sending footwear, a client should inform the Shop about it. 
All complaints are considered not later than 14 working days from coming in.  

§ 9.

Recording, protection and making available of sufficient agreement regulations take place after sending VAT invoice and/or order specification to a client.

§ 10.

Proper law that determines agreement between client and Daritom Bartosz Włodarczyk is Polish Law, especially Act from  2nd March 2000 about consumer protection and responsibility for damage made by danger product (Act. from 2000, No 22, idem. 271 with later amendments).

§ 11.

 Proper court that is responsible for considering arguments between sites as a result of sell agreement is District Court in Gdańsk (Poland).
